Terms & conditions of auction sale

Subject to amendments and modifications announced by the Auctioneer at the time of the auction, any person attending at the auction shall be bound by the following Terms and Conditions:

Auctions Inc. (“Auctioneers”) hereby grants to the party whose signature appears on the Bidder’s Registration Agreement (“Bidder”), the right to use the number shown hereon for the purpose of bidding at an auction sale to be conducted by Auctioneers. Such right is granted at the Auctioneers’ sole discretion and may be revoked at anytime.

The bidder hereby further agrees that whether he is acting as a principal, an officer or director of a corporation, or otherwise in any capacity whatsoever, the Bidder is personally liable for the payment of the purchase price and taxes payable with respect to any and all lot or lots for which the Bidder shall be the successful bidder of at the auction.

Upon presentation of your bidding card the Bidder’s Deposits will be return to bidders at the end of the auction and only when the auctioneer is satisfied that no successful bids were on your bidding number. Bidder authorize the auctioneer to e  debit their credit card with the full amount or part thereof, for any purchase if the Bidder’s account for items purchased is not settled within the time allotted in these terms of sale.

 

All goods are sold as is, when is, all sales be final and there shall be no exchanges, refunds or rebates. No warranty on the goods auctioned is given or implied by the Auctioneer and/or his principals. The purchaser shall be deemed to have relied entirely on his or her own inspections and investigations with respect to the description, suitability, merchantability, quality, quantity and condition of the goods auctioned. No sale shall be invalidated by reason of any defect or inaccuracy in any lots or by reason of being inaccurately described or incorrectly described in the catalogue, advertisements or elsewhere and no liability shall be some by the Auctioneer as a result of any such errors.

The Auctioneer shall have no liability for incorrectly describing any article or lot whether in the catalogue, advertisement or elsewhere. Descriptions have been prepared for guide purposes only and shall not be lelied on by the Purchaser for accuracy or completeness.

All sales are for Cash, Certified Cheque or Draft payable to CAS as follows:

a.           Full payment required same day of auction.

b.          Same day removal of your purchase require after  full payment .

c.           A 10% Buyer’s Premium will be applied to the purchase of any assets at this sale.

d.          A 5% Buyer’s premium on Automobile Purchases.

Bank Authorizations:

Corporate chques supported by a Canadian chartered bank latter of authorization guaranteeing irrevocable payment to Auctions Inc. group incorporated will be honored where a little from your finical institution will identify yourself and the corporate as customer(s) of the bank and state that he bank guarantees to Auctions Inc. Group Incorporate unqualified payment from your account # _____ listed herein up to the amount of #________ . This bank letter of unqualified guarantee shall be valid to June 30,2003.

All purchases must be paid for in advance for the goods being released. Goods may be removed only after presentation of an invoice marked “ paid in full” .To prevent any error, no purchase may assign, divide, dispose or transfers any lot or their right in any article purchased before full payment has been received by the auctioneer. No lots may be removed during the auction sale.

The auctioneer reserves the right to require payment in full during the sale .All money received from a purchaser, whether by deposit or otherwise, may be retained by the auctioneer as liquidated damages, in the event that the purchaser fails to comply with these terms. Lots not paid for and removed within the time allowed under these Terms of sale may be resold without further notice. Any deficiency realized on such sale in the excess of monies already paid shall be paid to the auctioneer by the purchaser, together with any expenses incurred by reason of such sale.

Purchases shall pay provincial sales tax or furnish a valid exemption certificate. Goods and services tax shall be charged unless the purchaser finishes satisfactory export documentation.

The auctioneer at his sole discretion may require any person to leave the premises when the sale is being conducted. All potential bidders must register and produce valid identification. The auctioneer may refuse to accept any bid from any person on any goods.

All bids are irrevocable. The auctioneer’s decision on all disputes with respect to bids, purchases and procedures shall be final and binding.

No goods shall be removed unit completion of the sale or until such time as the official posted or announced removal date. Removal of the goods is at the expense and responsibility of the purchaser. All goods are at the purchaser’s risk upon acceptance of the bid .The purchaser shall be liable for any damages to the building to the building caused as a result of handing of goods by the purchaser or his agents.

Where available, documents of transfer, including motor vehicle ownership documents, which are in the possession of the auctioneer, will be provided to the purchaser within 7 days following the auction or as soon thereafter as such documents are available.

Software and operating system are assumed to be for presentation and demonstration purposes only. License or the transfer thereof is provided for only where permitted by the manufacturers or distributors.

If the auctioneer is unable deliver an article sold to a purchaser due to fire, theft or any other reason whatsoever, the auctioneer shall reimburse the purchaser of all monies paid to the purchaser arising from or relating to such loss, including without limitation any damages or loss of profits.

Time shall be of the essence. If a purchaser fails to make payment or remove goods within the time periods here –in-above provided, the Auctioneer may resell the article purchased by auction, private contract or otherwise, as the auctioneer in his discretion deems advisable, and the purchaser shall be liable for the shortfall and all cost and expenses, including but not limited to interest rate (a minimum of 1.5 % per month or 18% per cent per annum) legal fees, moving and storage (a minimum rate of $6.00/sq per month) and commissions, incurred in such resale.

The auctioneer has the option of selling the goods individually, “en bloc” or in lots. The sale is subject to deletions and additions. The goods offered do not necessarily belong to the same estate .The auctioneer reserves the right to sell on behalf of third parties, its own account or on the account of others. The auctioneer reserves the right to sell subject to reserve and to purchase for its own account and for the account of others, whether by verbal or written proxy, all subject to prior sale.

The auctioneer is action as agent only and is not responsible for the actions of the auctions of his principals. Neither the auctioneer, vendor not owner of the premises assumes any responsibility for injury or loss to person or property of those attending the sale.  Attendance at the auction, preview or check out is done at the purchaser’s and/or their assigns or guests own risk. The auctioneer assumes no risk or liability, statutory or otherwise whatsoever for the safety of those attending at the auction premises.

All bids are subject to the forgoing. The auctioneer, in his sole discretion, may waive any of these terms of sales.

The successful bidders must remove purchases same day.

Any assets remaining will be deemed to have been abandoned by the bidder.
